EPLI (Employment Practices Liability Insurance)

EPLI covers defense costs and settlements for employment claims such as discrimination, harassment, retaliation, and wrongful termination.

Many PEOs include EPLI coverage in their bundle, but policy terms vary. The policy may belong to the PEO with clients as additional insureds, which can give the carrier and panel counsel control of the defense. Deductibles, sublimits, exclusions, and conditions tied to the PEO's HR guidance also require review.

Ask for the EPLI policy limits, the per-claim deductible you would owe, whether wage and hour claims are covered (they are often excluded or sub-limited), and what conditions attach to coverage. An employer with material claim exposure should compare the PEO's EPLI with a standalone policy it controls.
