A PEO for a marketing agency with 25 employees
Distributed teams, contractor-heavy delivery models, and talent competition with tech companies define the PEO evaluation for marketing and creative agencies.
What pricing looks like at 25 employees
At 25 employees, small differences in a per-employee fee compound into a material annual amount, and benefit participation can support more meaningful plan comparisons. Normalize percentage pricing to PEPM using actual payroll and compare the plan designs as well as premiums.
Minimal comp exposure: office and remote knowledge work with occasional travel. Workers comp will not decide anything here; multi-state payroll and benefits will.
Your leverage
A complete census, loss information, and a documented request for proposal can create useful competition. Ask each finalist to model state unemployment and workers compensation explicitly and to state how benefits renewal notice works.
When a PEO is the wrong answer at this size
If an experienced internal operator already manages HR, benefits, payroll, and compliance, a PEO may duplicate part of that role. Compare the PEO with an ASO or payroll platform while keeping the existing insurance and internal expertise.
Worth pricing when multi-state administration, benefit access, or contractor conversion solves a documented problem. A stable single-state agency should also price payroll software, a broker, and direct policies using the same workforce assumptions.
What a marketing agency should ask every PEO
- Agencies hire wherever the talent is, and each remote hire in a new state triggers registration, withholding, unemployment, and leave-law obligations that arrive faster than a small operations team can learn them.
- The freelancer-to-employee boundary is a live classification risk: long-running contractor relationships that look like employment are common in agency delivery models and expensive to defend.
- Talent competes directly with tech and in-house brand teams whose benefits set the market bar.
- Project-based staffing changes make clean performance, layoff, and severance documentation important when client work expands or ends.
Define the recruiting offer first, then compare the actual medical network and design, employer contribution, mental-health access, retirement terms, and leave policy support. Do not infer plan quality or eligibility from the PEO label or agency headcount.
Common questions
- We have employees in 9 states. Which registrations does a PEO handle?
- A PEO administers payroll, withholding, and unemployment under its arrangement across states, which can remove much of the per-state payroll setup. Corporate registration, local business taxes, and industry-specific rules can remain with the client. Get a state-by-state responsibility list in writing.
- Does a PEO fix our contractor classification risk?
- It reduces it only for the people you convert. A PEO gives you an efficient way to employ someone in a new state, which removes the main operational excuse for keeping long-term freelancers on 1099s. The classification analysis for those who remain contractors is still yours, and a PEO cannot bless a misclassified relationship.
